RESUMOO artigo científico visa esclarecer a fundamentação kantiana da doutrina da incorporação do Bill of Rights. A Suprema Corte dos Estados Unidos estendeu o Bill of Rights aos Estados. Neste trabalho pretendemos demonstrar a fundamentação kantiana na doutrina da incorporação do Bill of Rights, abordando a corrente filosófica do utilitarismo e do contratualismo. Em primeiro lugar, examinaremos o precedente da Suprema Corte dos Estados Unidos Gideon v. Wainwright (1963) e em seguida analisaremos filosoficamente o precedente. First, we will examine the precedent of the United States Supreme Court Gideon v. Wainwright and then we will philosophically analyze the precedent. This paper presents a new two-dimensional Multiple-Choice Model accounting for Omissions (MCMO). Based on Thissen and Steinberg multiple-choice models, the MCMO defines omitted responses as the result of the respondent not knowing the correct answer and deciding to omit rather than to guess given a latent propensity to omit. Firstly, using a Monte Carlo simulation, the accuracy of the parameters estimated from data with different sample sizes (500, 1,000, and 2,000 subjects), test lengths (20, 40, and 80 items) and percentages (...) of omissions (5, 10, and 15%) were investigated. Later, the appropriateness of the MCMO to the Trends in International Mathematics and Science Study (TIMSS) Advanced 2015 mathematics and physics multiple-choice items was analyzed and compared with the Holman and Glas' Between-item Multi-dimensional IRT model (B-MIRT) and with the three-parameter logistic (3PL) model with omissions treated as incorrect responses. The results of the simulation study showed a good recovery of scale and position parameters. Pseudo-guessing parameters ( d ) were less accurate, but this inaccuracy did not seem to have an important effect on the estimation of abilities. The precision of the propensity to omit strongly depended on the ability values (the higher the ability, the worse the estimate of the propensity to omit). In the empirical study, the empirical reliability for ability estimates was high in both physics and mathematics. As in the simulation study, the estimates of the propensity to omit were less reliable and their precision varied with ability. Regarding the absolute item fit, the MCMO fitted the data better than the other models. Also, the MCMO offered significant increments in convergent validity between scores from multiple-choice and constructed-response items, with an increase of around 0.02 to 0.04 in R 2 in comparison with the two other methods. Finally, the high correlation between the country means of the propensity to omit in mathematics and physics suggests that (1) the propensity to omit is somehow affected by the country of residence of the examinees, and (2) the propensity to omit is independent of the test contents. This study ascertained the association between spirituality and adherence or intention to donate blood in post-graduate students. In this quantitative and cross-sectional study, participants were 281 students from a post-graduate programme at a Brazilian public university. After complying with ethical requirements, data were collected through a questionnaire for sociodemographic characterization and identification of blood donation practices, followed by the Spiritual Well-Being Scale. Descriptive statistics and parametric tests (...) were used for data analysis. A total of 74% of the participants were female and 26% were male. Previous experience and/or intention to donate blood were found in 75.3%; 14.3% donated blood periodically. In addition, 12.2% were not adept to donation and 12.5% were inapt. Spiritual Well-Being scores were similar between individuals who are not adept and those who donate periodically. In conclusion, in the sample, spirituality and blood donation are not associated, but spiritual well-being and gender are. To enhance blood donation, further research is needed. (shrink)

System analyses deal with interrelationships between different variables that keep the system in balance. In many analysis of complex thinking, a system is viewed as a complex unit in which the ‘whole’ is not reduced to the ‘sum’ of its parts; the system becomes an ambiguous item because it consists of several entities that interact with unforeseen results or, in other words, it is situated at a transdisciplinary level, it is impossible for an area to have a complete reading of (...) its complexity. It was also mentioned that the concept of the open system best describes complexity by stating that ‘the laws of the organization are not equilibrium, but an imbalance that is restored or compensated for by stabilized dynamics’. This idea originated from the field of thermodynamics and the second law, in which the imbalance that it maintains allows the system for an apparent balance. This fragile steady state has something of a paradox, since the structures remain the same, but their constituents are changeable. The concept of open system undoes the door to a theory of evolution that can only derive from the interactions between a system and its ecosystem. Within this systemic approach, the focus of the analysis takes into account the ambiguity, multidisciplinary and complexity associated with system adjustment, i.e. it is intended to qualify an employee job based on their experience and knowledge as a measure of their impact on the organization performance. Background: Essential for the help relation, empathy is the ability to understand, share, and perceive the subjective experience of other human beings. Objective: The objective in this non-experimental, exploratory, and descriptive research was to verify, observe, and document empathy in nursing professionals. Research design: Non-experimental, exploratory, and descriptive research. Participants and research context: the study was conducted at two large hospitals, one public and the other private, across all shifts. The sample included 159 individuals. A questionnaire was used to identify (...) sociodemographic characteristics and the empathy inventory was applied. Ethical considerations: This study received approval from the Research Ethics Committee at the University of São Paulo at Ribeirão Preto College of Nursing, opinion 1348/2011, and authorization from the health institutions involved. Findings: The association tests demonstrated that professionals working in the night shift and in a work scale rotation scheme, older professionals, and professionals with longer professional experience are less empathetic. On the other hand, professionals working in the day shift and in a single shift are more empathetic. Other influential factors are the time on the job, education, and work shift. Conclusion: There is a lack of empathy studies in professional practice contexts, in human resource development programs, and throughout the professional education process. (shrink)

O presente trabalho tem por objetivo realizar uma análise da proposta de ensino em filosofia apresentada por (Rodrigo) (2009) em seu livro intitulado “Filosofia em sala de aula: teoria e prática para o ensino médio, apresentando reflexões a respeito das metodologias de ensino aplicadas nas aulas em escolas de Ensino Médio. Inicialmente será discutido o conceito de educação, aliado à importância da transmissão do conhecimento. Em seguida, será tratado da estruturação do método de ensino proposto, com destaque em suas (...) principais ideias e apontamentos para o campo da prática. Reconhecendo a docência como um exercício desafiador, se faz necessário o conhecimento de estratégias didáticas capazes de aproximar os estudantes do saber filosófico para ajudar a amenizar a dificuldade dos professores em conseguir captar a atenção dos alunos no momento de aula. A título de conclusão, serão traçadas potencialidades e limitações da metodologia apresentada, tomando como base experiências vivenciadas nas disciplinas de Estágio Supervisionado em Filosofia e no Projeto Residência Pedagógica, ambas desenvolvidas durante o curso de Licenciatura em Filosofia da Universidade Estadual Vale do Acaraú (UVA). There is an ongoing debate about the meaning of lexical words, i.e., words that contribute with content to the meaning of sentences. This debate has coincided with a renewal in the study of polysemy, which has taken place in the psycholinguistics camp mainly. There is already a fruitful interbreeding between two lines of research: the theoretical study of lexical word meaning, on the one hand, and the models of polysemy psycholinguists present, on the other. In this paper I aim at (...) deepening on this ongoing interbreeding, examine what is said about polysemy, particularly in the psycholinguistics literature, and then show how what we seem to know about the representation and storage of polysemous senses affects the models that we have about lexical word meaning. This paper presents a blueprint for an ecological cognitive architecture. Ecological psychology, I contend, must be complemented with a story about the role of the CNS in perception, action, and cognition. To arrive at such a story while staying true to the tenets of ecological psychology, it will be necessary to flesh out the central metaphor according to which the animal perceives its environment by ‘resonating’ to information in energy patterns: what is needed is a theory of resonance. This study examines the ethical dilemmas and difficulties encountered by Portuguese school psychologists. As part of a larger survey, participants were asked about ethical issues faced in daily practice and asked to describe ethical incidents. Of the 477 respondents, 274 reported 441 ethically troubling or challenging situations. Responses were coded into a six-category system based on the code of ethics of Portuguese psychologists. Most of the reported dilemmas concerned privacy and confidentiality principles. Results are discussed in light of relevant literature (...) and international findings. Sydney Shoemaker has been arguing for more than a decade for an account of the mind–body problem in which the notion of realization takes centre stage. His aim is to provide a notion of realization that is consistent with the multiple realizability of mental properties or events, and which explains: how the physical grounds the mental; and why the causal work of mental events is not screened off by that of physical events. Shoemaker's proposal consists of individuating properties in terms (...) of causal powers, and defining realization as a relation of inclusion between sets of causal powers. Thus, as the causal powers that define a mental property are a subset of the causal powers that characterize a physical property, it can be said that physical properties realize mental properties. In this paper we examine the physicalist credentials of Shoemaker's mind–body theory in relation to three important issues: the direction of the relation of dependence that the theory is committed to; the possibility of mental properties existing without being anchored by physical properties; and the compatibility of the theory with the causal closure of the physical world. We argue that Shoemaker's theory is problematic in all three respects. After that we consider whether the theory should count as a mind–body theory at all, given that it seems to be committed to a distorted view of mental properties. (shrink)

En este artículo sostengo que los tres filósofos/pedagogos cubanos del siglo XIX, Félix Varela y Morales, José de la Luz y Caballero y Enrique José Varona, fueron responsables de superar la enseñanza de la escolástica tardía en la Real y Pontificia Universidad de San Jerónimo de La Habana. Contra los filósofos y pedagogos escolásticos tardíos que preferían la lógica silogística y la autoridad de la tradición sobre la inducción, argumentaron a favor de esta última sobre la primera. Puesto que defendían (...) las ideas liberales y republicanas, también argumentaban en contra de aquellos que apelan a la autoridad de la tradición en lugar de a nuestras experiencias cotidianas. Su espíritu liberal desafió no sólo al régimen tiránico impuesto por España, sino a cualquier otro régimen cuya autoridad dependiera de la fuerza más que de la libre voluntad del pueblo a escoger sus gobernantes. I argue that, while unbeknown to most ordinary people, there is an ominous relationship between Gödel and President-elect Trump. The president-elect has flirted with the idea of being a one-day dictator when he assumes the presidency on January 20th, 2025. Less known is that when Gödel was studying the US Constitution to apply for his US citizenship in 1947, he claimed to have discovered a contradiction in the Constitution that could legally allow for the president to become a dictator. In this short piece, I acknowledge that there are two main hypotheses regarding the origin of Sars-Cov2: the zoonotic jump hypothesis defended by the scientific establishment, and the lab leak hypothesis defended by a minority of scientists. Despite the new evidence supporting the zoonotic jump hypothesis, I contend that the minority’s view still seems more reasonable to accept at this time than the majority’s view regarding the origin of the virus. I will try to justify the plausibility of the minority’s (...) hypothesis by deductive reasoning first and then by inductive reasoning appealing to the notion of Inference to the Best Explanation (aka, I2BE). Impairments in pragmatic abilities, that is, difficulties with appropriate use and interpretation of language – in particular, non-literal uses of language – are considered a hallmark of Autism Spectrum Conditions (ASC). Despite considerable research attention, these pragmatic difficulties are poorly understood. In this paper, we discuss and evaluate existing hypotheses regarding the literalism of ASC individuals, that is, their tendency for literal interpretations of non-literal communicative intentions, and link them to accounts of pragmatic development in neurotypical children. We present evidence (...) that reveals a developmental stage at which neurotypical children also have a tendency for literal interpretations and provide a possible explanation for such behaviour, one that links it to other behavioural, rule-following, patterns typical of that age. We then discuss extant evidence that shows that strict adherence to rules is also a widespread feature in ASC, and suggest that literalism might be linked to such rule-following behaviour. (shrink)

Tercero, exploro su eclecticismo dentro de su filosofía. Por último, explico el concepto de utilidad en el quehacer filosófico de Varela. Estos tres conceptos: filosofía, eclecticismo y utilidad están correlacionados en su obra. La filosofía con la recta razón. El eclecticismo, o lo que Varela llama la “verdadera filosofía,” con la sabia (...) selección de argumentos, incluyendo diversos métodos para explorar nuestras experiencias cotidianas, y la utilidad con la mesurada evaluación de nuestra conducta, incluyendo el bien común. Dado que estos tres conceptos son polisémicos, ellos pueden ser manipulados, y de hecho han sido tergiversados, por pensadores que han tratado de explicar el pensamiento filosófico vareliano con fines partidistas, ya sea con buenas intenciones o con fines ideológicos tendenciosos. This paper elaborates on the link between different types and degrees of experience that can be gone through within a form of life or collectivity—the so-called levels of immersion—and the development of distinct types of tacit knowledge and expertise. The framework is then probed empirically and theoretically. In the first case, its ‘predictions’ are compared with the accounts of novices who have gone through different ‘learning opportunities’ during a pre-operational training programme for running a huge nickel industrial plant in Brazil. (...) These are also analysed vis-à-vis the experience of an expert who has designed and experienced the outcomes of two pre-operational training sessions in the nickel industry before developing and managing the one discussed here. Theoretically, the framework is used to pinpoint exactly what interactional experts who have developed their expertise through linguistic socialisation alone are able to do as well as to analyse the case of technical connoisseurs. The results indicate that the proposed framework is useful. It supports the design and improvement of training programmes for the development of tacit knowledge while at the same time bringing about a refined analysis of claims concerning the abilities of types of experts and expertise. For many years, it has been common-ground in semantics and in philosophy of language that semantics is in the business of providing a full explanation about how propositional meanings are obtained. This orthodox picture seems to be in trouble these days, as an increasing number of authors now hold that semantics does not deal with thought-contents. Some of these authors have embraced a “thin meanings” view, according to which lexical meanings are too schematic to enter propositional contents. I will suggest (...) that it is plausible to adopt thin semantics for a class of words. However, I’ll also hold that some classes of words, like kind terms, plausibly have richer lexical meanings, and so that an adequate theory of word meaning may have to combine thin and rich semantics. Nosso texto pretende mostrar que está presente no pensamento schopenhaueriano, para além da sua definição “canônica”, uma outra concepção de filosofia que torna possível pensarmos uma filosofia prática de uma perspectiva propriamente empírica. Schopenhauer frequentemente define a filosofia como teoria metafísica de caráter contemplativo que abdica de toda normatividade. Contudo, encontramos uma outra noção menos elevada e mais próxima da dimensão prática da vida, orientada por uma perspectiva mais empírica e de caráter eudemonológico. Essa outra noção de filosofia torna possível (...) pensar uma ética não descritiva, que permanece alheia à normatividade moral, mas considera máximas que servem como recurso estratégico para uma vida mais suportável. En este artículo, la ética de la inmanencia de inspiración spinozista se propone superar el fondo mítico-existencial de la ética del origen y la visión de la técnica de Heidegger. Otros autores como Paul Ricoeur, Michel Foucault y Peter Sloterdijk aparecen aquí desde esa perspectiva crítica. Al final, se añade un breve comentario sobre la cuestión del mal.

Three questions animate Tuomo Tiisala's essay, “Overcoming ‘the Present Limits of the Necessary’: Foucault's Conception of a Critique”: What is the task of critique, as Foucault describes it? What is it about reason that necessitates such a task? And what is it that could motivate the critical attitude as a virtue?

O presente artigo tem como objetivo apresentar algumas considerações acerca de uma das noções chave da ética espinosana, a saber, a noção de afeto. Com essas considerações destacamos dois momentos: no primeiro, apontamos que, ao fazer uso da noção de afeto Espinosa pode pensar a afetividade humana de maneira distinta daquela pela qual foi pensada pela tradição, isso é, pode pensa-la não apenas do ponto de vista da paixão senão também da ação, o que implica, em outras palavras que, ser (...) afetivo não corresponde necessariamente a ser passivo. No outro momento discorremos acerca das duas definições de afeto presentes na Ética, procurando esclarecer uma e outra, e mostrar o porquê de Espinosa apresentar duas definições distintas para uma mesma coisa. Teaching mathematics and improving mathematics competence are pending subjects within our educational system. The PEIM (Programa Evolutivo Instruccional para Matemáticas), a constructivist intervention program for the improvement of mathematical performance, affects the different agents involved in math learning, guaranteeing a significant improvement in students’ performance. The program is based on the following pillars: (a) students become the main agents of their learning by constructing their own knowledge; (b) the teacher must be the guide to facilitate and guarantee such a construction (...) by being a great connoisseur of the fundamental aspects of the development of the child’s mathematical thinking; (c) the mathematical contents must be sequenced in terms of the complexity and significance for the student as well as contextualized at all times; and (d) the classroom must have a constructivist climate highlighting cooperative work among students. The implementation of PEIM along with the empirical evaluation conducted in several centers in Madrid and Zaragoza (Spain) confirm how students improve their mathematical competence. Both first- and second-grade students in elementary education were far more effective in solving problems, highlighting the use of more advanced strategies in their resolution and a lower incidence of conceptual errors. Moreover, it was possible to verify how the students proving greater difficulty, experienced an evolution in learning similarly to those who did not present it. The program provides customized education to allow the teacher to know at all times how he should be more influential on the students’ learning through mathematical profiles. Both teaching practice and teachers were observed, being that of the experimental group more prone to analyzing processes and allowing the construction of knowledge by students, due to their psycho-developmental training. As a result, we found several improvements through the implementation of the program that may serve, for upcoming years, as a basis for the necessary changes in the teaching of mathematics. (shrink)

Two connected questions that arise for anyone interested in inner speech are whether we tell ourselves something that we have already thought; and, if so, why we would tell ourselves something that we have already thought. In this contribution I focus on the first question, which is about the nature and the production of inner speech. While it is usually assumed that the content of what we tell ourselves is exactly the content of a non-linguistic thought, I argue that there (...) can be a lot of transformation in the process of converting a thought into words. Thus, the content of what we tell ourselves, being intrinsically linguistic, is different from the content of the thought our speech transmits. Fleshing out this kind of approach implies dealing with complicated questions which we lack enough knowledge about: the nature of non-linguistic thinking, and how speech (inner and overt) is produced; i.e. how the speaker goes from format a (format of thought) to format b (language). I show that these are pressing issues for any other position, but also suggest ways in which we could tackle such complicated issues. (shrink)
